Term of Sales
Scope of application
These terms and conditions apply to all professional training services provided by the Service Provider to its customers, both individuals and professionals, in mainland France.
Registration, payment and right of withdrawal
2.1. Individuals
● Training contract: signature of a standard "Individual" contract.
● Deposit: 30% of the total amount on signature.
● Right of withdrawal (art. L221-18 C. conso): period of 14 calendar days from signature, without penalty or reason.
○ This right suspends performance of the contract.
○ The deposit is reimbursed within 14 days of the request.
● Early start: if training begins before the end of the 14-day period, the trainee expressly waives this right (specific clause to be ticked).
● In the case of distance learning (e-learning), the consumer customer may, if he/she so wishes, expressly waive his/her 14-day right of withdrawal in order to benefit from immediate access to the platform. Full payment is due before the first connection, and mere access to the platform constitutes express waiver.
● Failing this express waiver, access to the training will be deferred until expiry of the legal withdrawal period.
2.2. Professionals
● Training agreement: signature of a standard "Professional" agreement with the company or funding organization.
● Payment: on receipt of invoice, unless expressly agreed otherwise.
○ Maximum legal deadline: 30 days end of month.
○ Late payment: penalties of 1.5% per month + fixed indemnity of €40.
2.3. Financing
Any request for funding (OPCO, CPF, France Travail, etc.) is examined in parallel; any refusal to provide funding does not affect the payment obligation: the Customer is responsible for payment of the full agreed price, even in the event of refusal or partial funding by a funding body.
The Service Provider may accompany the request for financing, but third-party financing is not a condition precedent to the sale. The Customer undertakes to pay personally any amount not covered by third-party financing.
